Terms of use

1. About these terms

Cellarnote is run by Gayan Padmasekara (ABN 80 269 645 453), a sole trader in Victoria, Australia (“we”, “us”). These terms apply when you create an account or use Cellarnote. If you don't agree with them, please don't use it. You can contact us at hello@cellarnote.com.au.

2. Who can use Cellarnote

• You must be 18 or over. Cellarnote is about alcohol.
• Keep your password to yourself. You're responsible for what happens in your account. People you invite to your household cellar can see and change its bottles.
• Give us a real email address so we can reach you about your account and billing.

3. Free trial

New accounts get a 14-day free trial with 5 wine lookups and 20 questions. No card is needed. When the trial ends, your cellar becomes read-only: you can still see, move, drink and rate your bottles, but adding bottles and the AI features need a plan. Nothing is deleted.

4. Plans, prices and payment

• Prices are in Australian dollars and include GST: Cellar $6 a month, Cellar (yearly) $60 a year, Collector $100 a year.
• Subscriptions renew automatically at the end of each month or year until you cancel. Payments are taken by our payment provider, Stripe, at the start of each period. We never see or store your full card number.
• Each plan includes an allowance of lookups (finding the details and current price of a wine Cellarnote hasn't looked up recently) and questions. Monthly allowances reset each calendar month; yearly allowances reset each billing year. Unused allowances don't carry over. Wines already in Cellarnote's shared catalogue don't use your allowance.
• If we change a price, we'll tell you at least 30 days before it applies to you. You can cancel before then.
• If a payment fails, we'll retry for a short time. If it still fails, your cellar becomes read-only until payment is made.

5. Cancelling and refunds

• You can cancel at any time from Settings → Billing → Manage subscription. Your plan keeps working until the end of the period you've paid for, then becomes read-only.
• We don't give refunds for part of a period, unless the Australian Consumer Law requires one. For example, if Cellarnote has a major failure, or we stop offering it before your paid period ends, you're entitled to a refund for the unused time.

6. Invitations and free accounts

Some people use Cellarnote free, by invitation. We can change or end free access with reasonable notice. Invitation links are personal; please don't share them publicly.

7. Your content

• Your photos, notes, ratings and cellar list belong to you. You let us store and process them only to run Cellarnote for you.
• To identify bottles and answer questions, we send label photos and relevant cellar details to our AI provider. See the Privacy Policy.
• When Cellarnote looks up a wine, the wine facts it finds (name, producer, vintage, region, tasting notes, drinking window, typical price) go into a shared catalogue so other people get them instantly. Your photos, notes, ratings, locations and quantities are never shared.
• Only upload photos you're entitled to use.

8. About the information Cellarnote shows

• Wine details, drinking windows, food pairings, prices and recommendations are produced with AI and web searches. They are often right but can be wrong or out of date. Check anything important yourself.
• Prices and cellar values are rough estimates, not valuations for insurance, sale or tax.
• Cellarnote doesn't give health advice. Check ingredients and allergens on the bottle, and please drink responsibly.

9. Fair use

Please don't misuse Cellarnote: no reselling access, automated or bulk lookups, scraping, trying to break in or overload it, or using it for anything unlawful. We can limit or suspend accounts that do.

10. Changes and availability

We work to keep Cellarnote running and your data safe, with nightly backups, but it may sometimes be unavailable for maintenance or reasons outside our control. We may improve, change or remove features. If we make a change that significantly reduces what you've paid for, you can cancel and get a refund for the unused time.

11. Ending your account

You can stop using Cellarnote at any time. Email hello@cellarnote.com.au to have your account and data deleted, or for a copy of your data. We may suspend or close an account that seriously or repeatedly breaks these terms, after telling you why where we reasonably can.

12. Your consumer rights and our liability

• Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.
• Otherwise, and to the extent the law allows, we aren't liable for indirect or consequential loss. Our total liability to you is limited to supplying the service again or refunding what you paid us in the 12 months before the claim.

13. Changes to these terms

If we change these terms in a way that matters, we'll let you know by email or in the app at least 14 days before the change applies.

14. Law

These terms are governed by the laws of Victoria, Australia.
